По поводу ареста судьи Дуган демократы ужасно возмущаются, особенно тем, что это якобы нарушает принцип разделения властей. Тут интересно не то, что это враньё - а это, конечно, совершеннейшая чушь и враньё, а то, почему они напирают именно на это.

Дело в том, что в их картине мира, между преступлением и наказанием нет связи. Точнее, не совсем так - связь есть, но она... как бы это сказать... о! зависит от контекста, вот. Преступление - даже совешённое публично, доказанное, всем известное и т.п. - совершенно не должно влечь за собой наказание. Посмотрите на реакцию левых на преступления, совершённые Луиджи Манджионе или Кармело Энтони. Они вовсе не желают, чтобы убийцы были наказаны. Что, они не знают, что убийство - преступление? Знают, конечно, просто партийный контекст такой, что наказание им не нужно. Это просто совершенно разные, не связанные в данном случае вещи. "Никто не выше закона" - это присказка для лохов, на самом деле никакого выше и ниже вообще нет, а есть партийный контекст и нужды партии. Необходимость соблюдения закона и неизбежность наступления наказания за его нарушение - всегда обусловлены этим контекстом.

И наоборот, когда партии нужно - преступление легко можно изобрести просто потому, что надо кого-то наказать. Политик может открыто идти на выборы с обещанием - я подвергну наказанию такого-то человека. За какое преступление? Да пофиг, найдём. И ни у кого не возникнет вопросов, а как же закон? Да всё норм, не боитесь, и закон найдём, и адвокатов найдём, которые подтвердят, что всё чики-пики. Да хоть профессоров права, если захотите - у партии есть ресурсы. Хотите 34 уголовных дела из воздуха - будут. 

И если понять эту точку зрения, то чей-то арест и наказание всегда являются функцией власти. Если у тебя власть - можешь наказывать, кого хочешь (ну, в рамках нужд партии, конечно, у нас не диктатура тут), если нет - не можешь. Если судью арестовывают - то вопрос возникает именно об этом - чья это власть такое делать? Откуда она у них? Как они смеют осуществлять власть над нашими судьями? Вопрос о виновности и невиновности просто не возникает - причём тут это вообще? Это к сути дела никакого отношения не имеет, это какое-то крючкотворство. Положите на место нашу власть, и мы быстро докажем вам невиновность, где хотите. Хоть в федеральном суде, хоть в апелляционнном. В Верховном пока ещё недостаточно власти, но это временно. А если не получается - это не потому, что закон не на нашей стороне, а потому, что они обманом захватили больше власти, чем им положено. Вот этим и имеет смысл возмущаться.
